Fanclub Rules of Procedure
Article 1 – Definition
This Fanclub is entitled » Rose Croix International ». This is the official international fan-club of the artist KAMIJO, which is managed by the « Rose Croix International » office, called the « Office » right below. To use the offered service Members need to agree these rules of procedure :
1 : As part of the use of our service, these rules of procedure apply to every « Rose Croix International » member, called the « Members » right below. With this membership which is defined in the articles 3 and 4, the subscriber is considered as a Member. This Member has to respect these rules of procedure.
2 :Every new rule added by the Office will be a part of these rules of procedure. When new rules of procedure content is different from the actual one, new rules of procedure statements will become the official one.
3:The Office as the right to change the Rules of procedure contents, without consulting the members. In this situation, members will be aware about changes.
Article 2 – Communication and agreements
1 : Communication from the Office can be done by e-mail, new posts on the website and official social networks or by any other way well-judged by the Office., besides an other rule of procedure annexed to this one.
2:Informations transmitted by e-mail are considered accomplished from the moment the message is sent to the members e-mail adresses. It belongs to Members to keep posted and read carrefully messages sent by the Office.
3 : In case Informations are announced on the official website, Informations are considered accomplished since Members can have knowledge of the informations by login on the website.
Article 3 – Membership
Only members who have fully filled their registration can access this service. Every person willing to register is called « Adherent ». Adherents must agree the Rules of procedure and must pay the membership and subscription fees through a payment method defined by the Office.
Article 4 – Membership Validation
1 : A membership is validated by the Office when the Adherent succesfully filled the membership form out. The Office will then allow the Member a private Member Registration Number.
2 : The Office has the right to decline a membership request in the following cases
(1)- The Adherent is already registrered as a Member
(2)- the Adherent request has been refused for rules infringement reasons
(3)- The Adherent filled false or wrong information in the membership form.
(4)- For any other reason the Office could judge applicable
Article 5 – Membership terms and renewal
This membership is valid 12 months. In case of non-renewal by end of term, membership will automatically ends. In the situation when the term date is overpassed, renewals processed during the reprieve period, will be considered agreed. Member will be renew and new terms will apply the same way as renewal before the term.
- Renewal period
From the first day to the last day of the term month.
(ex. : for a late march term => from the 01st of march to the 31st of march)
- Reprieve period
From the End until the 80th days following the term’s date.
(ex. : for a late march term=> until the 20th of June)
During the reprieve period , members do not have any access to their privileges and website account. Only access to renewing page is possible.
Article 6 – Registred information alteration
1: In case the Member does not update his informations, messages sent by the Office are considered readed even though sent to wrong or false email adress. It belongs to the Member to make sure all his personal informations are correct.
Article 7 – Deregistration
1 :Members can stop membership anytime by sending an e-mail requesting to unsubscribe to the Office. However subscribe and membership fees are not reimbursable.
2 : In case of non renewal of membership, Membership stops automatically at his terms.
Article 8 – Striking off
The Office can officially strike off anyone who have inadmissible behaviours. In case of striking off, every amount due has to be payed and are not refundable.
Members striking off reasons :
- – Cheating membership
- – prohibited behaviours, according to article 14
- – Delay or non attendance to amount due
- – Disturbing service
- – Behaviours in the opposite of our rules of procedure
- – Any other behaviour judged unbearable by the Office
Article 9 – Member Number
1 : Each Member has to manage his login and password to enter and surf into the website.
2 : Members cannot borrow, offer, sell, rent or make anyone stranger using his login and password.
3 : Each Member is only responsible for any damage resulting from his lack of care about keeping his login and password secret.
4 : In case of use or steal of Member login and password, it belongs to Member to alert the Office immediately and follow his instructions.
Article 10 – Use of Members informations
Members informations cannot be transmitted to anyone stranger to the Office, or to any organisation, according private life law rules ( Article 9 – French code civil), in exception of the following situations :
1 : Express and written consent of Member
2 : In case of subscription to events managed by « Rose Croix Japan ». In this situation the Office will inform the involved member.
3 : In case of a law complain.
Article 11 – Provided Services
The membership advantages
1 : Receive posts sent by the Office.
2 : Take part to all event, free or payable, organised by the Office, besides the following cases :
(1)- When the audience exceeds capacity, a lottery will be realised
(2)- In case of prohibited behaviour, according to article 14
(3)- In case of purchasing in the purpose of to resell or offer Tickets to the events.
3 : Priority Booking for concerts and events tickets, besides the following cases :
(1)- When the audience exceeds capacity, a lottery will be realised
(2)- In case of prohibited behaviour, according article 14
(3)- When local partner is not collaborating to Fan Club Rules
(4)- In case of purchasing in the purpose of to resell or offer Tickets to the events.
4 : Limited goods purchase for members, besides the folowing cases :
(1)- When the audience exceeds capacity, a lottery will be realised
(2)- In case of prohibited behaviour, according to article 14
(3)- In case of purchasing in the purpose of to resell or offer Tickets to the events.
5 : Priority Informations mailing
Article 12 – Services contents modifications
Anytime, the Office can add, modify, stop or delete part or the whole services contents.
Article 13 – Subscription
Member has to pay the membership and subscription fees when joining the FC. In case of renewing, subscription must be renewed and processed during a period defined by the Office.
Article 14 – Prohibitions
1 : The following behaviours are prohibited :
- – Injuring other members, a third party or the Office and his copyrights
- – Injuring other members, a third party or the Office’s property or private life
- – Leading lost or damaging the Office.
- – Slanderous Behaviour towards the other members, a third party or the Office
- – Offenses against morality
- – Criminal acts
- –Voting aim within the Fan Club
- – Sexual, religious or political activities within the fan-club
- – Resselling , offering, or doing any financial activities within the FC services
Cheating use of the member number
disturbing our computing service,
- – Acting against the Law
- – Any behaviour which the Office could judge inadmissible
2 : In case of dammage caused by any unpleasant behaviours, listed, involved member must assume legal responsabilities, even after being striked off.
Article 15 – Property
Fan Club content (website, member’s forms, member’s privileges, mailing, etc…), bélongs to the Office.
Article 16 – Copyright
1 : Use of contents provided by the service, (website, member forms, member privileges, mailing, etc…) is allowed only for personal purposes. whatever the circumstances are it is forbidden and illegal to use contents without Office agreement.
2 : Members are not allowed to broadcast, share or post contents provided by the service, without Office agreement.
3 : In case of inconvenience caused by this article infringement, Members have to solve the conflict themselves without any possibilities to involve the Office.
Article 7 – Service Discontinuity
The Office has the right to end this service in the following cases :
- – In case of war, riots, labor conflict, earthquake, volcanic eruption, flood, tsunami, blaze, interruption of electricity or any other similar cases, which does not permit our service to be run the normally.
- – When the Office will judge necessary to stop the service, for executive reasons.
1 : In case of dicontinuance of the service, the Office will alert the members in advance, except for cases of extreme urgency.
2 : The Office assumes no responsabilities in case of this service disturbance repercussions.
Article 18 – Responsability exemption causes
1 : Besides the informations and provided elements and materials Under the name « Rose Croix International », the Office does not guaranty any accurancy, truth, sureness or usefulness of any other information outstanding.
3 : In case of Fan Club facing difficulties because of the artist new activities, a part or the whole fan-club could be dissolved.
4 : In the cases listed above, the Office will not reimburse any membership or subscription fees.
Article 19 – Juridiction
In case of litigation due to interpretation or application of the terms of the contract, the contractors agree that the French Judges of Tribunal de Commerce in Paris will run the conflict but only after all amicable solutions and settlements failed.
